To the extent any portion of these Terms and Conditions is determined to be unenforceable by a court of competent jurisdiction, such portion will be modified by the court solely to the extent necessary to cause such portion to be enforceable, and these Terms and Conditions, as so modified, shall remain in full force and effect.

Waiver. No waiver by NorthShore of any right under or term or provision of these Terms and Conditions will be deemed a waiver of any other right, term, or provision of these Terms and Conditions at that time or a waiver of that or any other right, term, or provision of these Terms and Conditions at any other time.

Taxes. At NorthShore Care Supply, applicable sales tax or sellers use tax is charged on orders when delivery is made within the following states: Alabama, Arizona, Arkansas, California, Colorado, Connecticut, Florida, Georgia, Idaho, Illinois, Indiana, Iowa, Kansas, Kentucky, Louisiana, Maryland, Massachusetts, Michigan, Minnesota, Missouri, Nebraska, Nevada, New Jersey, New Mexico, New York, North Carolina, North Dakota, Ohio, Oklahoma, Pennsylvania, Rhode Island, South Carolina, South Dakota, Tennessee, Texas, Utah, Vermont, Virginia, Washington, West Virginia, Wisconsin & Wyoming. Sales tax or sellers use tax rates will be calculated at final checkout and may vary depending on origin address, delivery address, or type of good purchased. Tax will also be assessed on delivery charges if required respective by state for type of goods purchased. Reduced tax, tax exemptions or tax on delivery charges are based on each state's tax requirements for the category of goods purchased. Not for Resale. All sales from NorthShore Care Supply are NOT FOR RESALE without prior written approval. Purchasers shall not directly or indirectly: market or resell any products purchased from NorthShore through any means, including outside marketplaces, (i) to any consumers, resellers, distributors, or third-party sales agents; (ii) through retail storefronts, online stores, or auction or resale websites; (iii) to any federal, state, or local government agencies, public education institutions, or healthcare entities.

Purchasers shall not stock products for future sales. All requests for resale can be made here.  Purchasers from NorthShore that claim their purchases are exempt from sales and/or use taxes must provide valid documentation to NorthShore before sales and/or use taxes will be removed from transaction. Transactions exempt for resale purposes must provide valid resale certificate. Transactions exempt for governmental or non-profit use must provide state exemption letter and payment must be made directly from exempt organization. NorthShore requires written proof that exempt governmental and non-profit transactions are being paid directly from the organization. Transactions paid by employees or contractors for future reimbursement by exempt organizations will not qualify as exempt transactions from NorthShore; rather only transactions where exemption letter from state is provided AND payment is made directly by the exempt organization. For other exemptions not mentioned here, NorthShore will review on a case by case basis and request specific documentation as applicable.

Absorbency Testing. Absorbencies listed for products on absorbency charts or product pages are determined by proprietary testing designed to simulate absorbency before leakage in real-use application of the product. Some of the manufacturers of products in our catalog also publish absorbency amounts determined by using a testing procedure known as ISO 11948-1, The Rothwell Method. However, NorthShore does not publish Rothwell amounts on our site as we believe Rothwell absorbencies are misleading to consumers as the test is not designed to produce absorbency amounts applicable to consumers. The Rothwell test, in short, dunks the product in a bucket of fluid and weighs the product afterward to determine the net absorbency. Rothwell testing requires absorbencies to include fluid that is standing and not absorbed into product in the measurements. Studies have shown that there is a moderate correlation between Rothwell absorbencies and real-use absorbencies, however, Rothwell amounts tend to be about three times higher than absorbency before leakage from tests that try to simulate real-use of products. Note: Some manufacturers include Rothwell amounts or absorbencies determined by other methods on their product packaging and, therefore, may list amounts different than shown on NorthShore’s website due to the variance in testing methods.
